Failing to Submit Annual Reports, Businesses Utilizing Marine Space Faces Rp5 Million Daily Fines

Jakarta, Indonesia Sentinel — The Indonesian Ministry of Marine Affairs and Fisheries (KKP) announced that businesses holders of Marine Spatial Utilization Activity Conformity (KKPRL) documents who fail to submit their annual reports could face fines of up to Rp.5 million (approximately $310) per day.

Doni Ismanto Darwin, Special Staff to the Minister of Marine Affairs and Fisheries for Public Relations and Communications, urged businesses to promptly comply.

“Submitting an annual report is mandatory for all KKPRL document holders,” Doni said in an official statement on Monday, April 28, 2025. “We have repeatedly reminded them that sanctions will apply for delays, and even more so for failure to submit.”

According to the Directorate General of Marine and Fisheries Resources Surveillance (PSDKP), 739 KKPRL document holders have either delayed or failed to file their annual reports.

Meanwhile, over the past five years, the ministry has issued 2,530 KKPRL documents. Of these, 17 have been canceled or revoked, exempting their holders from the annual reporting requirement.

Doni emphasized that the annual report requirement is mandated under Ministerial Regulation No. 28/2021 on Marine Spatial Planning. Enforcement of sanctions for non-compliance is governed by Ministerial Regulation No. 31/2021.

“These reports are critical for assessing the holders’ commitment to responsible marine space utilization, including environmental management and socio-economic responsibilities toward coastal communities,” Doni added.

The reports must also outline progress on obtaining Environmental Approvals and Business Permits, as well as the realization of the authorized water area usage.

Previously, Minister of Marine Affairs and Fisheries Sakti Wahyu Trenggono said the KKPRL system ensures that marine activities are properly managed to prevent conflicts between businesses, protect coastal communities, and safeguard marine ecosystems.

Fajar Kurniawan, Director of Marine Spatial Utilization Control at the Directorate General of Marine Spatial Planning, said that submitting the annual report also provides legal certainty for marine-based business activities.

KKPRL documentation is a prerequisite for obtaining business permits under Articles 4 and 5 of Government Regulation No. 5/2021, and must be processed through the Online Single Submission (OSS) system.

Under Ministerial Regulation No. 28, a KKPRL document is valid for two years if not followed by active business operations. Meanwhile, business permits can remain valid for up to 20 years, depending on the nature of the activities.
