The newly introduced privacy legislation in Colorado aims to protect individual privacy by imposing strict requirements on entities that process personal data, with added protections for sensitive information. This law expands the definition of ‘sensitive data’ to include ‘biological data,’ covering genetic, biochemical, physiological, and neural information.
Among the companies involved in brain-implant technology is Neuralink, founded by billionaire Elon Musk. Additionally, numerous companies are developing wearable technology designed to capture brainwaves. For instance, Amazon offers sleep masks designed to optimize sleep and headbands intended to enhance focus.

However, many companies have yet to establish clear limitations on the extent of access their devices have to neural data in human brain. A recent study by The NeuroRights Foundation revealed that 29 out of 30 companies investigated did not provide specific restrictions on such access.
“The consumer neurotechnology revolution is centered on improving the ability to capture and interpret brainwaves,” explained Sean Pauzauskie, the Medical Director of The NeuroRights Foundation.
Pauzauskie noted that advancements in this technology could rapidly evolve over the next few years, potentially achieving prominence similar to the rapid rise of ChatGPT. “In the next two to five years, a ChatGPT-like moment is not out of the question.”
