Mining Tycoon Harvey Moeis Faces 12-Year Sentence for Corruption

Jakarta, Indonesia Sentinel — Mining entrepreneur Harvey Moeis has been sentenced to 12 years in prison for alleged corruption involving the misuse of operational permits at PT Timah (Persero) Tbk. (TINS).

The verdict, delivered during a session at the Corruption Court (Tipikor) on Monday night, December 9, also requires Moeis to pay a fine of IDR 1 billion. Failure to pay will result in an additional one-year prison term.

Additionally, Harvey Moeis has been ordered to pay restitution of IDR 210 billion, with a subsidiary sentence of six years in prison if the full amount is not settled.

“If the restitution amount is partially paid, it will be considered when calculating the duration of the additional prison sentence,” stated the prosecutor.

Moeis was found guilty of violating Article 2 Paragraph (1) and Article 18 of the Corruption Eradication Law in conjunction with Article 55 Paragraph (1) of the Criminal Code, as well as Article 3 of Law No. 8 of 2010 on Money Laundering Prevention and Eradication.

Case Details

The charges against Moeis involve his role representing PT Refined Bangka Tin in collaboration with PT Timah. He was accused of working with other defendants to process illegally mined tin from PT Timah’s concessions. The prosecutor alleged that a portion of profits from smelter operations was disguised as funds for corporate social responsibility (CSR) activities.

The corruption case allegedly enriched Moeis and co-defendant Helena Lim by IDR 420 billion.

Money Laundering Allegations

In addition to corruption, Moeis was charged with money laundering. Prosecutors claim he transferred illicit funds to his wife, actress Sandra Dewi, and her assistant, Ratih Purnamasari. The assistant’s account was reportedly used to cover Dewi and Moeis’ daily expenses.

Prosecutors detailed Moeis’ lavish spending, which included the purchase of 88 luxury handbags, 141 pieces of jewelry, and high-end assets such as properties, luxury vehicles (MINI Cooper, Porsche, Lexus, and Rolls-Royce), and the rental of a luxury home in Melbourne, Australia.

The court highlighted the severity of the case, noting that Moeis’ actions resulted in state financial losses of IDR 300 trillion.

This landmark case underscores Indonesia’s ongoing efforts to combat corruption, particularly in the natural resources sector, which is often marred by illegal mining and mismanagement.
